BlueNest Care Recruitment Ltd was founded in Sheffield by Eric Kalongo, a care sector professional who worked as a frontline carer and witnessed first-hand the chronic staffing crisis facing homes and the hardworking carers who deserved better support. What began as a local mission has grown into a national ambition: to become the UK's most trusted care staffing agency.
We did not build BlueNest Care from a boardroom. We built it from the care home floor, drawing on our own experience as a frontline carer. What stood out to us was not a lack of committed carers, but rather a fragmented system that failed to connect them effectively with the care homes that needed them most. Welcome to BlueNest Care Recruitment Ltd. By accessing our platform, requesting personnel, or registering for care opportunities, you agree to comply with and be bound by the following comprehensive terms and conditions of use.
Throughout this contract, "Agency" implies BlueNest Care Recruitment Ltd. "Client" refers to any organization, care home, hospital trust, or individual utilizing our candidate supply networks. "Candidate" refers to any healthcare worker, assistant, or nurse registered on our deployment roster.
2.1 These Terms constitute the entire agreement between the Agency and the Client for the supply of temporary Staff. By requesting, accepting, or engaging Staff, the Client is deemed to have accepted these Terms in full.
2.2 Supervision & CQC Boundaries: In accordance with UK care regulations, the Agency operates strictly as an employment business. The Client acknowledges that the Staff are supplied to work under the Client’s direct management, clinical direction, control, and supervision. The Client is entirely responsible for the day-to-day management, care planning, task allocation, and operational outcomes of the care delivery on their premises.
3.1 The Agency warrants that all Staff deployed undergo stringent vetting prior to placement, including: verified Right to Work in the UK, an Enhanced DBS check (and/or registered Update Service tracking), comprehensive reference verification, and verified mandatory training compliance (including Safe Moving & Handling, Safeguarding, and Basic Life Support).
3.2 The Agency will provide a digital Compliance Profile containing necessary verification evidence to the Client prior to or at the commencement of a scheduled shift assignment.
4.1 The Client agrees to pay the hourly charge rates agreed upon at the time of booking, which are subject to variations based on shift timing (days, nights, weekends, or bank holidays).
4.2 Invoices are issued weekly by the Agency based on signed timesheets. The Client must pay all undisputed invoices within thirty (30) days from the date of the invoice.
4.3 In compliance with UK Conduct Regulations, the Agency remains legally liable for processing and distributing timely payroll to all temporary Staff regardless of any outstanding or delayed invoice payments from the Client.
5.1 If a Client cancels a confirmed shift booking with less than twenty-four (24) hours' notice, the Agency reserves the right to charge a standard cancellation fee equivalent to four (4) hours of the agreed shift rate.
5.2 The Agency enforces a mandatory 2-hour pre-shift check-in window for all Staff. In the rare event of a sudden staff emergency or absence, the Agency will make every effort to deploy an on-call backup worker immediately and notify the Client transparently.
6.1 If the Client engages or employs a member of the Agency’s Staff directly or via another third party within six (6) months of that worker’s last assigned shift with the Client, the Client shall pay the Agency a standard Transfer Fee or agree to an extended period of hire, as specified in our fee schedule.
7.1 While the Agency checks qualifications and compliance, the Staff work under the absolute direction of the Client. The Agency accepts no liability for any loss, damage, expense, or injury arising from any act, omission, or negligence of the Staff during their assignment.
7.2 The Client shall maintain comprehensive Employers' Liability, Public Liability, and Professional Indemnity insurance policies covering the temporary Staff throughout their operational duties on-site.
